Chapter 4 of the Guide to LA FOIP is now available!

Chapter 4, Exemptions from the Right of Access of the Guide to LA FOIP is now available! Local authorities will find helpful information in this chapter including guidance on such topics as:

  • Interpretation of Exemptions;
  • Class and Harm Based Exemptions;
  • Mandatory and Discretionary Exemptions;
  • Exercise of Discretion;
  • Public Interest Overrides; and
  • Guidance on each of the exemptions in Part III of LA FOIP.

Up until now, local authorities have been relying on Chapter 4 of the Guide to FOIP for assistance. However, this new chapter is tailored specifically for The Local Authority Freedom of Information and Protection of Privacy Act (LA FOIP). There are many similarities between LA FOIP and The Freedom of Information and Protection of Privacy Act (FOIP). There are also things that are unique to LA FOIP. For example, LA FOIP includes provisions not found in FOIP such as section 15 – documents of a local authority. We hope you find this chapter useful as you work through processing access to information requests under LA FOIP.

In terms of progress, Chapter 5, Third Party Information and Chapter 6, Protection of Privacy will be in the drafting phase shortly and will be published to the website over the next several months.
